Licensing Program

The IPGATE patent portfolio comprises more than 400 granted and pending patents covering core technologies used in modern automotive brake-by-wire systems. These include integrated braking systems of different generations, architectures designed for autonomous driving with redundant control concepts and multiple ECUs, as well as vehicle motion control systems integrating braking, stability control and torque vectoring functions.

In essence, the portfolio covers two core brake-by-wire architectures: one-box electro-hydraulic brake-by-wire systems with fail-safe functionality, and two-box systems combining an electro-mechanical brake booster with an ESP unit. The patents address fundamental system architecture, control logic and safety-critical functions implemented across virtually all modern brake-by-wire solutions.

IPGATE offers its Integrated Braking Systems (IBS) portfolio under a FRAND-inspired licensing framework. The portfolio is organized into several licensing packages and includes a total of 177 independent main claims across multiple jurisdictions, including Portfolio A with 51 independent main claims and Portfolio B with 83 independent main claims. A complete list of the patents is available for access and download here.

The IBS portfolio license includes Integrated Braking Systems – Generation 1, a system combining brake force boosting and individual wheel brake pressure modulation within a single compact unit (License Packages A1 and A2). The license also covers Integrated Braking Systems – Generation 2, which employs dual-action reciprocating pistons to ensure consistent and reliable braking performance through precise pressure control during both piston movements (License Package B1). In addition, the IBS Generation 2 portfolio includes technologies related to advanced diagnostics, pressure modulation and compact system packaging (License Package B2).

Tier-1 suppliers implementing technologies covered by the IBS portfolio are required to obtain a license, as the portfolio claims core architectures of modern integrated braking systems, including, among others, pedal simulation, dual-action actuators and fail-safe pressure control. These patented technologies constitute key building blocks for compliant brake-by-wire and electro-hydraulic braking systems.

In light of the foregoing considerations, the FRAND-inspired royalty rate applicable to the IBS portfolio is set out as follows :

FRAND-inspired royalty rates
Export markets 5.0% of the net sales price of the brake-by-wire system with a minimum License Fee of CHF 5.00 per Licensed Product
China domestic 0.5% of the net sales price of the brake-by-wire system with a minimum License Fee of CHF 0.75 per Licensed Product
The standard patent license agreement for the IBS portfolio can be downloaded here in English and here in English/Chinese. Information regarding the FRAND-inspired license fees, together with the underlying reasoning and Royalty Benchmark Memorandum, is available for download here.
